17 Year Old Charged with Death of Long Beach Man Found Burned in Palos Verdes

There has been a break in the case for Long Beach Police Officers when a 17 year old boy came forward and spoke with homicide detectives about the dead body found earlier this year in Palos Verdes. 

The victim’s (Christopher Waters, 42,) body was found in an SUV that was set on fire in Rancho Palos Verdes around April of this year.  According to reports, the teen defendant was charged Friday with murder and is currently being held at the Los Padrinos Juvenile Hall in Downey. 

To date, he cause of death was not released nor has the motive for the alleged murder been revealed. 

Will the Defendant be charged as an adult? That is the question the C. BRADFORD LAW FIRM is posing today! Most likely this case is fit for a 707(b) situation in which the Prosecution can direct file and get the juvenile into adult court. 

With regard to 707(b) offenses the child is presumed NOT to be fit for juvenile court and the juvenile has the burden of proving that they are fit for juvenile court. Not only does the juvenile carry the burden of establishing that they are fit for juvenile court but the court must find that they qualify under each and every of the five criteria. A finding of “non-fitness” under any one of the five will result in the juvenile being unfit for juvenile court and forced to be adjudicated in adult court. For 707(b) offenses the prosecution has the ability to “direct file” adult charges and the juvenile’s case will automatically be heard in adult court. For the prosecutor to direct file, the crime must be under 707(b) and the child must at least 16 years of age (14 under Proposition 21 in California). Essentially, a 13 year old will never be charged as an adult even if it is a 707(b) offense.

In this situation because the Defendant is above 16 years of age, the Prosecution does not have to have a “fit and proper” hearing under the 707(a) standards and can immediately place this Defendant in adult court if necessary.
