911 Tape for Zimmerman Trial

The Court is expected to rule today in whether the 911 tape in the George Zimmerman trial will be admitted.  The determination comes through a motion in limine, and the decision of the Court will determine whether or not the jury will hear the tape. 

It is alleged that there is a voice on the tape (that is the victim Treyvon Martin) begging the Defendant. 

A state expert claims that he heard Martin saying “I’m begging you” in the background of the call. Other experts, however, have testified that the quality of the tape was too poor to determine who was screaming. James Wayman is also expected to testify that audio work done by the state’s experts should not be trusted.


16 year old Arrested in Slaying of Two Elderly Individuals

An older couple killed in their Davis home in April of this year, died from multiple stab wounds.  According to the Yolo County Coroner says the two bodies identified as Oliver Northup and his wife Claudia Maupin, were both stabbed multiple times.  The deaths have been classified homicide. Northup and Maupin were found inside their home along Cowell Boulevard, near Mace Boulevard, Sunday night.

The police went to check on the elderly couple after reports that no one had heard from them in days. 

UPDATE ON THE CASE: Police have arrested a 16-year-old boy in connection to the murder of two elderly Davis residents. 

Police say the 16-year-old Davis resident, who is not being identified because he is a minor, is being held to charges for the double murder. Police believe there are no other suspects in the case.

The couple were found inside their home along Cowell Boulevard, near Mace Boulevard, back on April 14. Multiple stab wounds were found on the two, and investigators found signs of forced entry into their home.

Neighbors say the Davis home being investigated by FBI went up for sale shortly after the couple was found murdered.

Officers from the Davis Police Department, the Federal Bureau of Investigation, the California Department of Justice, the Yolo County District Attorney’s Office, the West Sacramento Police Department and the Dixon Police Department helped served the warrants Monday.

The investigation into the murder is on-going, with police still asking anyone with information to call them at (530) 747-5400.


Custody Battle Strong: Its not about you

In my years as a practicing family law attorney, not once have I seen a case been truly litigated for the benefit of the minor children involved. It was best said by a Minnesota judge: 

“Your children have come into this world because of the two of you.  Perhaps you two made lousy choices as to whom you decided to be the other parent.  if so, that is your problem and your fault.  

No matter what you think of the other party-or what your family thinks of the other party-these children are one-half of each of you.  Remember that, because every time you tell your child what an “idiot” his father is, or what a “fool” his mother is, or how bad the absent parent is, or what terrible things that person has done, you are telling the child half of him is bad.

That is an unforgiveable thing to do to a child.  That is not love.  That is possession.  If you do that to your children, you will destroy them as surely as if you had cut them into pieces, because that is what you are doing to their emotions. 

I sincerely hope that you do not do that to your children.  Think more about your children and less about yourselves, and make your a selfless kind of love, not foolish or selfish, or your children will suffer.”

I was recently presented with a custody declaration and could not believe how many personal accusations the declaration contained.  While yes, perhaps that person was not the best partner to you, that does not mean they are not a good parent.

UC Riverside Student Pled Not Guilty

A break up can be tough on any individual, and sometimes people never recover from them.  The real personality of a person comes out when they are at their worst and generally for most people, a break up can do that.  

That is the case is at hand this morning.  A UC Riverside student, Barbara Wu, has been arraigned on charges including, solicitation of murder, terrorist threats, stalking and other various crimes. 

Wu asked Dennis Lin, who dated Wu, to kill her ex boyfriend.  Needless to say Lin sought a restraining order against Wu on May 24, two days after Wu’s request. In the Request for a Restraining Order Lin wrote that Wu made him promise on May 22 that he would break the man’s legs with a baseball bat, kill him and discard the body.

At the request of police, Lin recorded Wu discussing the alleged plot.

Wu was arraigned on May 31 and remains jailed.

THE CRIME: Solicitation of Murder, Terrorist Threats and Stalking. 

THE PLEA: Not Guilty 

What got her caught: The mere fact that she asked someone else to kill her ex-boyfriend. He then documented everything in his request for restraining order and cooperated with the police.  If this proves true, she clearly solicitated the wrong person.  

THE MOTIVE: a bad break up. 

THE DEFENSE: Too early to tell!

LA Foster Care Contractor Alleged of Financial Mismanagement and Child Abuse

A vote by the LA County Board of Supervisors cancelled a contractual relationship that had been in existance for decades with a foster care agency.  The reasoning behind the cancellations were the allegations of financial mismanagement and child abuse at the hands of the staff.  

The Agency in question in known as Teens Happy Homes.  The major concern brought to the board’s attention were that many teens were living in unsafe conditions.  After initial investigation two supervisors moved to end the relationship but struggled to get a third supervisor’s support. At its Tuesday meeting, the board unanimously canceled the contract without comment.

While this decision by the Board is in the best interest of the children; the end result is placing a further stress on the an already extended system. Officials hope that most of Teens’ children can remain with their current parents under a new foster care provider, but they worry some may drop out.

Officials believe that the abuse is actually larger than what has been reported, and is a problem within the system.

Father wears Nazi Uniform to Court in an attempt to gain Custody and/or Visitation of his children. All three children were given German names, which the court is stating are “Nazi Names”

The youngest child was taken from the home moments after being born.

Rapper Robbed!

Tauheed Epps, who is a platinum selling rapper known as 2 Chainz (never heard of him) was robbed in San Francisco merely hours before he was scheduled to perform at a concert in Oakland. 

The Atlanta-based rapper was in the Bay Area to perform at KMEL-FM’s annual Summer Jam concert Sunday night at the Oracle Arena in Oakland.

Epps was walking with five, you heard that right FIVE members of his entourage near downtown Sunday afternoon. They were approached by three men, one of them holding a handgun.  One shot was fired. 

The rapper lost his cell phone and wallet with cash and credit cards.  Police say the suspected shooter apparently got away in a gray sedan.

The Crime: The robbers face potential charges of (1) Assault with a Deadly Weapon (ADW) and (2) Robbery.
